In execution of a Credit Line Deed of Trust from Mary C. Griffith, dated October 28, 2004, recorded November 2, 2004, as Instrument No. 040007376, at page 94, in the Clerk's Office of the Circuit Court of Henry County, Virginia (the "Deed of Trust"), the Trustee, Clement & Wheatley, a Professional Corporation, having been requested to do so, will offer for sale at public auction, at the entrance to the Henry County Circuit Court located at 3160 Kings Mountain Road, Martinsville, Virginia, at:
10:00 a.m., March 13, 2015
(the "Sale Date")
the following described property with improvements thereon (the "Property"), situate, lying and being in Henry County, Virginia, and being described as follows:
All that certain parcel of land situated on the West side of Horsepasture-Price Road (State Road 692), in the Horsepasture District of Henry County, Virginia, as shown by map made by C.M. Wyatt, Surveyor of the C.E. and Rachel Williams property on September 20, 1958, and being more particularly described as follows: BEGINNING at a point on the West side of Virginia State Road 692, which point marks the dividing line between the property herein conveyed and that of Joyce, and running from said beginning point and with said dividing line, South 68 inches West 265 feet to a fence post; thence South 4 feet West 63 feet to a stake and post; thence North 81 feet and 271 feet to the West margin of State Road 692; thence with the same 112 feet to the point of beginning, being part of the same property conveyed to Mary C. Griffith from Frank Vernon, et ux by deed dated February 17, 1955, of record in the Henry County Circuit Court Clerk’s Office in Deed Book 129, page 325.
This sale is subject to all conditions, restrictions, reservations, declarations, easements, leases and rights-of-way of record or contained in the deeds forming the chain of title to the Property, and subject to any and all prior liens, including, but not limited to recorded and unrecorded mechanics' and materialmens' liens, if any. WARRANTIES: THE PROPERTY AND ALL THE IMPROVEMENTS LOCATED THEREON WILL BE SOLD IN THEIR "AS IS" CONDITION WITHOUT WARRANTY OF ANY KIND.
TERMS OF SALE: ALL CASH. Purchaser shall pay for all recording charges (EXCLUDING Grantor's Tax), examination of title, settlement fees and all costs of conveyancing. Transfer of title of the Property to the purchaser shall be by special warranty deed of bargain and sale. To bid on the Property, each bidder, other than the noteholder, shall qualify as a bidder by demonstrating to Trustee prior to bidding the ability of such bidder to satisfy deposit requirements immediately upon acceptance of a bid by delivery to Trustee of deposit IN CASH or by CERTIFIED or CASHIER'S CHECK of $2,500.00, or 10% of the sale price, whichever is lower. Unless otherwise agreed to in writing, settlement in full shall be made within 30 days from the date of the sale. Taxes will be pro-rated to the date of the sale. If the Trustee fails to convey title to the Property to the Purchaser, the Purchaser’s sole remedy is return of the deposit.
Delivery of possession of the Property will be the responsibility of the purchaser. The Purchaser may be required to execute a Memorandum of Sale containing terms and conditions relating to sale and the purchase of the Property, a copy of which will be available immediately before the sale. The Trustee reserves the right to amend terms of the sale by announcement prior to sale.
